Psychs Pervert Court System & Destroy Lives

Of course, you don't need to believe me but I wouldn't suggest personally experiencing it yourself. Here's a couple of items for you to help decide:

This young lady had her children taken away in Alameda:

"... what are my rights regarding this issue specifically & the issue at hand (in relation to CPS)?
Their PhD recommended that they do (psych) med monitoring since I had not complied with medication previously. I didn't find out what her report said until just recently. In fact, I wasn't taking the meds when I saw her, but I was scared silly to tell her that due to the threat that was made to me by the John George doctor. I just answered her generically when asked about medication. Again, I had no symptoms when I was sent to JG, but they said that I had to take the medication if I wanted to see my kids - which they ended up not letting me do. I have copies of all my medical records & there are so many inconsistencies that it is not even funny. My name wrong, marital status, things that I never said, exaggerations, ect...

"just a side note - the patients in John George need more advocates to stand by them, give them advice & help them fight for their rights. Had I not been soooo scared, I would not have taken the meds while there so I could prove to them all that I never needed it. It was REALLY sad seeing some of the people there - some of them very sick, others so doped up on meds that they
wanted to sleep all day, others I'm sure a little love/care or PTSD treatment, etc. would help.)"

And here is a posting a father placed on Craiglist:

"Ms Cutina Maddox, an 'assessor' for the family court services has recommended that an 11 year old child continue to live in an abusive home, despite an overwhelming amount of evidence, that she has been abused, and will continue to be abused. The abuser in this case is her mother. The child has told Ms. Maddox, that she is living in a home, where she is constantly being yelled at by her mother.

"The father is an exemplary parent. He has been fighting this for six years, in two different courts. The first court, evaluated the mother, Helena G*****, and described her as being "Narcisstic, Manipulative, and Controlling". Her manipulating has included such tactics as accusing the child's father of molesting the daughter. (How Original!) That was her claim to the very first judge in this case. This judge saw it for the obvious lie it was, and told the mother's attorney, that her client was obviously lying. No less than three judges, have called Ms. G****** a liar to her face, and yet they continue to allow her to submit lie after lie to the court. When the father documented all of Ms. G*****'s lies to the Family Court Services assessor, she simply ignored it, and the child's pleas to be put with her father, who not even Ms. G****** has faulted as a parent, and instead has decided to grill the father, because Ms. G****** is displeased with the airline ticket he buys, so his daughter can fly to Southern California, to spend a few hours with her Daddy, the only place where she feels safe.

"This gives great credence to the growing belief, that our family court system deliberately will place a child in an abusive home, knowing fully well, that the wronged parent will do everything they can to protect their child. http://www.youtube.com/profile?user=CJEMarin The judge in this case, Nancy Bernardini, seems to be somewhat aware of the deceptions, peddled by Ms. G***** and her attorney. Unfortunately, Family Court Services is not doing their part, in making sure that the judge receives accurate information Family Court Services was to do an 'assessment' Instead, they give a recommendation, with absolutely no information to indicate why they have made such a recommendation. This leaves the opposing party to try to blindly fight the recommendation, without being able to address any specific issues. I contacted Lili Genz, the director of Family Court Services in San Jose, and she all but hung up on me, refusing to discuss her assessor's recommending that the child continue to live in an abusive home."

"The last time I saw a Dr. Hughey in Pleasanton, I recorded the conversation, and he AGAIN wrote a "bogus report". I wrote him a letter asking if he's a QME (qualified medical examiner), etc., & he of course didn't respond. Also, Dr. Rudolph Cook in San Jose. I don't know what the significance of '12/90' is ? They won't answer that either.

"I wrote to the medical board of CA & gave a list of Doctor's names & addresses. I then sent a CERTIFIED mail/return receipt since they didn't answer me. I'm still awaiting a reply.

"They are ALL violating my CIVIL & HUMAN RIGHTS . . . retaliation for my complaints against them, etc."

US Court of Appeals: Social Workers Have No Absolute Immunity

This is BIG news. A quote from the Court Appeals decision just published days ago: "Furthermore, as prosecutors and others investigating criminal matters have no absolute immunity for their investigatory conduct, a fortiori, social workers conducting investigations have no such immunity. "

(fortiori: adverb with greater reason; for a still stronger, more certain reason; "if you are wrong then, a fortiori, so am I" )

Adventures in Haircuts

Got a haircut yesterday at the same place I always get a haircut, however it has now changed ownership for the third time in probably less than a year. I walked in to the salon and there was a lady napping in one of the chairs. I said hello several times to wake her up but was reluctant to nudge her in fear of her waking up in a panic and accusing me of sexual harassment.

Fortunately, after a few minutes, another employee walked out and woke her up. She snapped to, wiping the drool off her chin and walked to the back, while another lady came to the front and I was able accomplish my mission.

The prior owners of this shop delivered more than haircuts, however. The girl who used to cut my hair one time asked if I wanted a massage, whispering in my ear that it would be fun and make me "feel good". I declined, she persisted, but I prevailed in my refusal despite the fact she held the scissors in her left hand and an electric razor in her right hand. (And I was definitely not going to shell out fifty bucks.)

The next time I went there to get a haircut, she upped the menu by coyly whispering how we could give each other a massage, once again promoting how good it would feel AND fun. I politely declined yet started to think she was being a bit too, well, skanky, for the lack of a better term.

I decided to report this to the police, since the storefront did not promote two-way fun massages. I typed up all the data (as well as another report on another possible situation) and drove off to find a police officer. Since it was a late Sunday afternoon, I figured I would find one at a nearby Starbucks. My highly tuned intuition proved correct - there were two police units there. I approached the officer with the most chevrons on his uniform, greeted him and while holding out the report, let him know I wanted to report possible criminal activity in the neighborhood. He immediately put his hands behind his back as a reaction (as opposed to a normal action), wouldn't accept it and told me to go to the Police Station and they would take the report.

Okay, being the good citizen, I drove downtown as any Superhero would. Approaching the desk, I started placing the reports under the bullet-proof window and talking to the officer there. He wouldn't accept the reports at all, instead started giving me flack about this and that. I took both reports back and walked out (after noting his name and badge number).

Not to be stopped, a couple of days later (because I had immediately gotten ill for two days) I went to the Independent Police Auditor (IPA) to relay my concerns - can't someone get a hair cut without being harassed?! Actually, I didn't say that. Anyway, I gave the IPA the reports which gets relayed to the Internal Affairs Unit.

A couple of days later I was contacted by a Sgt. from Internal Affairs and we met the next day at the police station where I once again relayed the whole story (even though it was already in writing). He was very nice, listened without accusing me of anything and let me know what he will be doing to correct the situation.

I followed that up with personal letters to the Chief of Police and the head of Internal Affairs. (Interestingly enough, a few weeks later when I attended a public forum on police records being opened up to the public especially when someone dies from being tased, the Commander of the IA saw me, and, in effect, thanked me for the letter.)

I never found out (nor asked) if the police actually did anything with the hair salon. I still got my hair cut there once a month, was offered a massage one more time but that apparently was taken off the menu thereafter. (What, she doesn't like me anymore?!)

So, coming full circle to yesterday's haircut; new owners, no massage, no fun, just a haircut.

Boring.

San Jose Police Dept - All-White Command

I read an article in the SJ Mercury yesterday about how Chief Davis has established his inner-circle of Deputies and that they are all-white and male. Comparisons are made to other cities with quotes from the NAACP and the Hispanic community served to raise eyebrows and controversy. I only give the article a "B-" as there was not enough sex and money controversy thrown into it.

Chief Davis has been under fire over the last couple of years on the subjects of Tasers, public records and racial profiling by his department, so this promises to be more fodder for attacks on him and the Department.

Having watched him speak at a public forum and personally spoken to him on several occasions regarding police misconduct and racism, I have found him very sincere and took to heart the concerns that I brought forward to him. He did not stonewall, brush me off nor cop an attitude (sorry, I just had to throw that pun in there.)

Apparently, in the past he has had a 'mix' in his command staff, however he encountered an interesting situation: As soon as a certain requirement is accomplished to earn a pension or whatever it is called, you can retire and then soon after go work in a police department at a more smaller, safer community for a good chunk-a-change while still being paid your pension from your old job. So, no one is discriminating about the color green here, I guess. I don't know why Chief Davis doesn't bring THAT up in the articles, maybe its not true or not politically correct or something. If any one knows the real deal on this, please send me a correction.

Some months back, I visited the Independent Police Auditor (IPA) office. I was told that the number of complaints regarding police 'rudeness' had been increasing, and from what I remember, the claims of racism wasn't a huge issue necessarily. There was no concern of racism as an 'institutional' problem within the SJPD.

For what it is worth and possibly ironic for those of you that are true believers in color management, I believe the head of Internal Affairs is of Vietnamese descent. (So, nothing like having an Asian to keep the white man under control?!)

While different agencies are being ordered to take more 'ethnic sensitivity' training, it should probably include training on the 'white-ethnic' as well before it gets all out of balance. Reading that text-book would be interesting.

Regardless, I want people who are QUALIFIED to do the job and one of those qualifications is, NOT being racist.

Setting the Record Straight, Kinda

* I received an email from a reader who made several excellent points so I am following through here. Many of the stories I am relaying here are ONLY from one side of the story. Due to privacy and confidentiality laws it is very difficult to get the full story on each incident. In a number of cases, I am able to verify some points of each story and overall, the complaints I receive generally follow a common problem encountered which to me lends the complaint(s) as more valid than not, that is, more probably true than not. I don't know if my blog 'reads' as biased or one-sided although I do try to be fair and use words such as, "reportedly", "alleged", things like that.

* I do not use names out of respect for privacy, and the complaint not fully verified. Another aspect of this is I am not just a spectator in the stands, booing and jeering. I meet with county officials, court officers, law enforcement and other non-profits to resolve not just specific cases but overall organizational actions or inactions, so chastising them personally in a public forum doesn't help me solve things.

* In regards to Child Protective Services and the other agencies connected to this, I know that there are many dedicated people implementing programs to drastically improve the scene. They are aware of the faults and do feel very bad about injustices that occur. I work WITH them to forward those programs. But meanwhile, I have to deal with the bad parts and will undoubtedly have to for awhile as nobody is perfect.

* A purpose of this blog is let people become aware that injustices and abuses are occurring, to hopefully prevent further wrongs, and gain support in helping resolve them. What is not covered in this blog are the actions I take to contribute to solving the problems.

* In future postings, there will be more hopefully helpful hints on things that work in navigating through our system, so that my blog becomes more informatively helpful.

Big Pharma - Big Profits - Big Penalties?

I Told You So

* Check out the latest Metro News article entitled, "Diary of a Breakdown in Santa Clara County's Juvenile Justice System." A well-written factual article of how a mother is trying to fight for her son's rights in the juvenile system.

* A Psychologist referred a Family Therapist to me because her grand-daughter was taken from their family by CPS. There's something ironic about all of that for some reason. Anyway, in talking to her I was able to guess who the Judge was overseeing her case. She was pretty impressed with that.

* Another report was received of a Social Worker telling a father, in a supervised-visit with his daughter that if he gave her a piece of candy, the visitation would be ended right then and there. Aside from the ridiculousness of it, reportedly the Judge had ordered that it was okay to give a piece of candy to the daughter. Pretty sad that a Judge has to make a ruling on such a thing.

* I received a request to help on a situation of a father molesting his grand-daughter which I think I mentioned in an earlier posting. I alerted the San Rafael Police Department a couple of weeks ago but haven't heard anything back. Guess I'll have to call up and find out what's the deal on this.

Better Here Than San Francisco

Last year, Santa Clara's Child Protective Services placed 52% of the children that had been removed from their home back with the family or relatives. This reportedly is an improvement. As a comparison, San Francisco has a 13% placement of children back to the family or relative. Glad I am working in Santa Clara and not San Francisco. Someone better get to work up there.

Additionally, efforts are being made by the Santa Clara Dept of Family & Children Services to institute a meeting with concerned family members to resolve placement issues with children after they are removed but before it gets into the court system where the parent and children pretty much have no say in the matter and it becomes very adversarial with Public Defenders, Social Workers, County Counsel, Judges, parents,, families all involved in making decisions without every really spending adequate time to fully observe the situation and dynamics of the family and children concerned. The bad news is apparently the Social Workers' Union is bucking this as it would supposedly make more work for the Social Workers so they want more Social Workers hired and paid more or something. I think the welfare of the children and the families are more important than being overworked and one's pocketbook.

Rumor has it that the San Jose Mercury News has a series of articles coming out this month on how the Public Defender's Office is not doing such a hot job in defending the rights of parents in CPS cases. I hear that there are going to be some changes there meanwhile. Did you know that in Hawaii, there are no Public Defenders in these CPS cases? Community Members stand in and protect the rights of the children and families which I think is pretty cool.

You've probably seen the stories on Britney Spears and her unfortunate situation. She has quite a battle personally and with the System now to get herself and her family put back together. As she was also involuntarily committed, it wouldn't surprise me if she is put on psychotropic drugs - although it wouldn't be a revelation if she was already on those death drugs. Whomever had been 'treating' her obviously has done a criminally disgusting job on helping her.

This Planet is Bonkers

- I've been off blogging for a month, so appalled at the abuses I couldn't write anymore. Well, new year, new adventures. But mainly, I was waiting to see if anyone noticed. A reader mentioned to the lack of postings by me so here we go again!

- San Rafael: A 70 year old plus father is accused of molesting his 2 year old granddaughter. Apparently, he has a history of molesting his own daughters yet none of them had reported this to the proper authorities or anything else effective. Last summer, one of the daughters actually found child porn magazines in the dad's house and did nothing about it. As one result, another of her sister's daughter is molested. It gets better - a Psychologist ignored reports of molestation and instead placed the father in charge of visitations with his grandson. Stay tuned.

- San Jose: In order to regain custody of a 3-year old girl out of foster care, a family member had to request special exemption for a DUI that occurred almost five years ago. The Social Worker that we shall call, "Tony" (because thats his name), held on to the request for 10 days, then added his own 2 cents to the report before submitting it to his boss on - New Year's Eve. Of course, since it was disapproved the Supervisor had to call that day to tell the family member the bad news. Social Workers pine to become part of the extended family to help them through reunification services, but Tony seems to have some strange idea about that. Basically, it was timed to pass on the bad news on what should be a day of positives.

- San Jose: I've been requested to contact a former employee of Eli Lilly Pharma who apparently has a bone to pick with their business practices.

- Milpitas: A mother is requesting help as her daughter was put on psych drugs, turned violent, beat up her boyfriend and is now in Elmwood "Correctional" Facility where she is being fed more psych drugs.

- Unfortunately, there are a number of other cases but I can't even allude to them yet. When the time comes.
